1. General

1. These Terms and Conditions apply to your use of the General Engineering & Safety Supplies Ltd ("GES", "we", "us" or "our") website and to orders placed through the website.
2. The website allows you to browse, select and purchase products from GES. By using the website or placing an order, you agree to be bound by these Terms and Conditions.
3. "You" and "customer" means the person or legal entity purchasing products from GES.
4. These Terms and Conditions are governed by the laws of New Zealand. You agree to submit to the non-exclusive jurisdiction of the courts of New Zealand.

3. Placing an Order

2. When you place an order, you are making an offer to purchase the selected products at the price shown at the time of ordering, together with any applicable delivery charges and GST.
3. Your order is not accepted by GES until we confirm acceptance of the order. We may accept or decline an order at our discretion in accordance with these Terms and Conditions.

5. Once an order has been accepted, we will provide confirmation of the order by email.

4. Product Availability and Pricing

1. We make reasonable efforts to ensure that product descriptions, images, availability and pricing on the website are accurate. However, errors can occasionally occur.
2. We may refuse or cancel an order where a product is unavailable or where there is an obvious error in the product description or price.

4. Prices displayed on the website are in New Zealand dollars and include GST where applicable.
5. Website prices may differ from prices available in our Alexandra or Cromwell stores. We are not required to match website and store pricing.

7. Any promotional pricing or discounts are subject to the terms of the relevant promotion.

5. Back Orders and Out-of-Stock Products

1. If a product you have ordered is unavailable, we may offer to place the product on back order.
2. Where a product is placed on back order, we will advise you of the expected availability where this information is available.
3. If a product cannot reasonably be supplied, we may cancel the affected part of your order and refund any payment received for that product.

6. Delivery and Collection

1. We deliver to locations within the areas covered by our available delivery services.
2. Delivery options and charges will be displayed during the ordering process where applicable.
3. Certain products may be subject to delivery restrictions, additional charges or collection-only requirements due to their size, weight, dangerous goods classification or other transport requirements.
4. Where multiple delivery charges could apply to an order, GES may apply the highest applicable delivery charge rather than combining multiple charges.
5. Estimated delivery timeframes are provided as a guide only and may be affected by courier delays, weather, rural delivery requirements, product availability or other circumstances outside our control.
6. For click and collect orders, products will be available for collection from the selected GES store once we have confirmed that the order is ready.
7. You are responsible for ensuring that the delivery address and contact details provided with your order are accurate.
8. Unless otherwise agreed, delivery to the address provided by you will be considered delivery to you or to a person authorised by you to receive the order.

7. Risk and Title

1. Ownership of products passes to you once payment has been received in full and the products have been delivered or collected, subject to any rights you may have under applicable New Zealand law.
2. Risk in the products passes to you upon delivery or collection, except where otherwise provided by law.

8. Payment

1. You must pay the purchase price and any applicable delivery or other charges shown during the ordering process.
2. We accept the payment methods made available on the website at the time of purchase.
3. All payments are processed in New Zealand dollars.
4. If a payment cannot be successfully processed, we may contact you to arrange an alternative payment method or cancel the order.
5. You must not use a payment method fraudulently or without authorisation.

9. Damaged, Faulty or Incorrect Products

1. Please check your order when it arrives and contact us as soon as reasonably practicable if a product has been damaged, is faulty, is incorrect or is missing.
2. Where possible, please provide details of the issue and photographs of any damage or other relevant information to help us resolve the matter.
3. Products that are faulty, damaged or otherwise covered by your rights under the Consumer Guarantees Act 1993 or other applicable New Zealand law will be dealt with in accordance with those rights.

10. Change of Mind Returns

1. We may accept change-of-mind returns in accordance with our Returns Policy.
2. Our Returns Policy sets out the conditions that apply to change-of-mind returns, including applicable timeframes, proof of purchase and product condition requirements.
3. Change-of-mind returns do not affect your rights under the Consumer Guarantees Act 1993 or other applicable law.

11. Cancellation of Orders

1. If you wish to cancel an order, please contact us as soon as possible.
2. We will consider cancellation requests based on the status of the order and whether the products have already been dispatched or collected.

Your signed credit application remains binding and applies in addition to these Conditions of Use. Where there is any conflict between these Conditions of Use and the terms of your credit account, the terms of your credit account will apply to the extent of that conflict.
